Any use of the ATOME service implies the unreserved acceptance of these GTC and confirmation that you have read, understood and accepted these GTC.
The contract is concluded between ATOME, SARL with a share capital of 9,001 euros, registered in the Paris Trade and Companies Register under number B 449 356 237, whose registered office is located at 7 rue Guénégaud 75006 PARIS, in the person of its legal representatives, Mrs Jeanne-Cécile MASSONI and Mrs Frédérique QUELVEN, hereinafter called ATOME, on the one hand, and the Student, on the other hand.
The purpose of this contract is to set the contractual conditions for putting the Student in contact with a host family residing in Paris, for a given period.
A separate and autonomous contract from the agreement will be concluded between the family and the Student.
As soon as the deposit is received, ATOME guarantees accommodation. These fees will not be refunded under any circumstances in the event of cancellation by the Student. However, they will be valid for the current year in the event of a postponement of the stay.
If the visa is refused, the student is reimbursed 100% (less any bank charges) up to 15 days before arrival.
14 days before arrival, if the visa has still not been issued, the student must notify Atome.
If the student wishes to maintain his/her registration during these 14 days, in the event that the visa is not definitively obtained, the student's stay will be cancelled without refund or postponed to the current calendar year without penalty.
If exceptionally ATOME could not find a family to host the Student, ATOME will refund 100% of the payment less any bank charges.
Payment methods are made online by PayPal or by bank transfer
Bank charges are the responsibility of the customer.
The price of ATOME's services is provided for in the contract.
Payment of the price will be made no later than 15 days before the Student's actual arrival date with the host family.
This contract takes effect upon payment of the price realized on that date. Payment is understood as the actual receipt of the price. It shall end at the end of the period provided for in the contract. Failure to pay the price in full or in part by the due date shall automatically render the contract null and void at the Student's own fault, without it being necessary to have this null and void in court.
In addition, in the event of partial payment, ATOME will retain all sums received.
In case of cancellation of a reservation due to the Student:
Stays started late, or interrupted before the end, are due in full. Unused services such as meals, will not be reimbursed.
If the Student is absent for a few days or weeks, no refund will be made. Unless prior arrangement to be made with ATOME, which will propose to the Student a fixed amount corresponding to the maintenance of his room during his absence.
ATOME undertakes to take all necessary steps and make its best efforts to enable the Student to be put in contact with a host family domiciled in Paris, in order to allow the Student to stay for the said period.
ATOME undertakes to provide the Student with the family's bank details (as soon as possible when these details are communicated to it) in order to enable the Student to be able to proceed directly to the payment of the family.
In addition, any service not included in this contract and which may be requested by the Student from ATOME, will be invoiced on the basis of the rates in force.
The services of ATOME are obligations of means. In the event of cancellation by the Family before the Student's arrival date, the Student will be fully reimbursed for the sums paid. ATOME undertakes to make its best efforts to offer the Student another Family. In any case, ATOME cannot be held liable under any circumstances when the cancellation results from the Family's fault.
The described ATOME obligations are agreed within the limit of force majeure.
The Student undertakes to collaborate with ATOME in order to ensure the proper execution of the service and to provide ATOME with the information and essential elements concerning it (Questionnaire and Calendar).
The Student undertakes to provide ATOME with copies of the following documents 30 days before the beginning of his stay:
The Student undertakes to maintain in force the documents referred to above during the term of this contract and during the term of any Hosting Contract.
The Student undertakes to hold an interview with the family to be presented by ATOME, in order to allow the Student and the family to validate together their joint decision to sign a Housing Contract and to agree on its terms.
The Student declares that he/she is fully aware of the conditions under which his/her reception will take place at the Family's home and in particular that a private room will be reserved for him/her at the Family's home as well as access to certain common areas (bathroom, WC and kitchen to prepare dinners in agreement with the family), access to the other rooms of the apartment being left to the family's discretion and fixed in the contract that will bind them. In this respect, the Student declares on his honor that he undertakes to respect the Agreement Charter. One laundry per week will be carried out by the family. In any event, in the event of damage or loss affecting the Family's home or its furniture and resulting from the Student's actions, the Student undertakes to reimburse the Family in full for the damage suffered.
The Student's stay is governed by the contract between him and ATOME. All changes must be seen with ATOME. The Student wishing to extend his stay must imperatively inform ATOME at least 3 weeks in advance.
In the event of any serious disagreement between the Family and the Student noted during the stay and leading to the termination of the contract between the Family and the Student, ATOME undertakes to make its best efforts to present the Student with a new Host Family, as soon as possible in consideration of the availability of the time and the material and administrative constraints. If a second disagreement/incompatibility is found with the replacement family at any time following the arrival of the Student in the replacement foster family, the Family and the Student concerned shall be responsible for the possible termination of the contract between them, but ATOME shall not be required to present the Student with a new foster family.
ATOME reserves the right not to replace the Student if he does not respect the conditions of the contract.
ATOME reserves the right to dismiss a student if he or she does not comply with the rules and regulations as well as the rules of good conduct. In such a case, no refund is considered.
ATOME does not accept any claims made after departure.
Finally, in the event of a serious event occurring in the host family (e. g. death, expulsion, etc.) that prevents the Student from continuing his or her stay at the family's home, ATOME undertakes to make its best efforts to introduce the Student to a new host family as soon as possible, taking into account the availability of the time and material and administrative constraints.
The perfectly autonomous nature of the Family/Student contract with regard to the present contract means that in all cases of possible early termination of the Family/Student contract, the Family and the Student are personally responsible for the consequences of termination and in particular the Student is personally responsible for the reimbursement to him, by the Family, of any excess received by the Family at the date of termination.
Any external, unforeseeable and irresistible event constitutes a case of force majeure. It is also contractually agreed that the termination of ATOME's activity constitutes a case of force majeure.
The parties agree that in the event of the occurrence of a case of force majeure, the party who will suffer the case of force majeure will be exempted from the execution of this contract without being able to be held responsible for it and without its contractual liability being sought in any way.
It is agreed that in the event that the case of force majeure continues for a period of more than 15 days or in the event that the case of force majeure definitively makes it impossible for a party to perform its obligations, the contract between ATOME and the Student will be terminated automatically and without the need for a court decision ordering termination.
The Student undertakes to take out an insurance policy guaranteeing his liability towards the Family and its property.
It is agreed that the French language is the language of the contracts.
Under no circumstances can ATOME be held liable for the Family's failure to perform or improper performance of the contract.
In the event of a claim or dispute, it is the Student's responsibility to contact the Family directly and to incur civil liability or the multi-risk home insurance taken out by the Family, if applicable.
ATOME is neither a real estate provider nor a hosting provider. ATOME is an intermediary between the Student and the Family.
Any dispute relating to the interpretation, execution or termination of the contract is subject to French law.
